Terms of Service (TOS)
Artist: Utainsy1. General Provisions
1.1 These terms apply to all individual commissions for illustrations, designs, and other artistic work.
1.2 By commissioning a piece, the client automatically agrees to all points outlined in this document.
1.3 I reserve the right to update or modify these terms at any time without prior notice.2. Copyright & Usage
2.1 As the creator, I retain full copyright to all commissioned artworks unless otherwise agreed in advance.
2.2 The client receives either a personal or commercial license for usage, depending on what was agreed.
2.3 The artwork may not be altered, resold, or redistributed to third parties without my written permission.
2.4 Proper credit must be given upon publication: @Utainsy
2.5 I reserve the right to share the commissioned work in my portfolio, on my website, and across social platforms, unless confidentiality has been specifically requested and agreed upon before the project begins.3. Work Process
3.1 Work on a commission begins only after full or partial payment is received.
3.2 I reserve the right to decline any commission without needing to provide a reason.
3.3 The client will receive regular progress updates (sketches, colors, stages), except for orders under the “Surprise” or “Smoll” formats.4. Payment
4.1 Prices are fixed and confirmed before work begins.
4.2 Payments are accepted via Google or Apple Pay.
4.3 Payments are non-refundable.5. Turnaround Time
5.1 The estimated turnaround time is up to 3 months, depending on the complexity of the piece and my schedule.
5.2 I do not accept rush commissions. If you have a specific deadline, it must be communicated when placing the order. I will then confirm whether I can meet it or not. Pressuring me to speed up may result in lower quality and/or cancellation of your commission.6. Final Deliverables
6.1 The client will receive the finished piece in .PNG format, with no watermark and a transparent background.
6.2 Source files (e.g. .PSD) will not be provided unless discussed in advance.
6.3 The final artwork may not be used in AI-generation tools or as NFTs under any circumstances.7. Design Reuse
7.1 If the client cancels the commission or ends collaboration, I reserve the right to reuse parts of the work (sketches, colors, character concepts) in future personal projects or for adopts.8. Client Conduct
8.1 I expect respectful and professional communication from the client throughout the entire collaboration.
8.2 Aggressive, rude, manipulative, or passive-aggressive behavior — including pressure, blackmail, or demeaning comments — will result in immediate cancellation.
8.3 In such cases, no refund will be issued.
8.4 I reserve the right to blacklist the client and deny any future collaboration without explanation.9. Legal Validity
9.1 These terms come into effect the moment the client agrees to work with me — regardless of whether the order was placed via social media, email, form, or any other method.
9.2 By commissioning me, the client agrees to all terms in this document, even if they have not read it in full.
9.3 I may refer to this document as a record of agreement in the event of disputes or to protect my rights.

Extra

I do not charge any hidden fees, I am committed to transparent pricing, and you will know the full price before I start working. If you need any of the extras listed below, you must let me know at the beginning of the commission.

1. Commercial Use
A commercial license is required only if the artwork I create is used on commercial products (physical merchandise, books, games, prints, packaging, etc.).
In such cases, the total price is x2.2. Publication Restriction
Upon request, I can refrain from publishing the commissioned work for up to 6 months at no additional cost.
After this period, I reserve the right to publish the work in my portfolio, on social media, or my website — unless otherwise agreed in advance.
If you request a permanent publication ban, the total price is x2.3. Anonymity
If the client requires full anonymity (no name, username, or identity connected to the work), I agree to keep it fully confidential — provided this is communicated in advance.
This does not require additional payment, unless combined with a complete publication ban.4. Priority
If you want to avoid the queue, you can discuss it with me. If agreed, the cost of the commission is +50%.
Please note: this is not considered “rush”.5. File Storage
Project files are stored for up to 3 months after completion.
After this period, I do not guarantee the availability of these files or the ability to make further edits.6. Communication
I do not work or reply to messages from Saturday to Monday.
